Variations to Development Standards Register

Development standards are set by either the Kempsey Local Environmental Plan 2013 or state environmental planning policies. These standards provide specific limits for particular aspects of development, including building height and floor space ratio. 

Variation of development standards is possible under rules set by legislation, including where strict compliance would be unreasonable or unnecessary or where there are sufficient environmental planning grounds to justify the variation. 

Council maintains a publicly available online register of all variations to development standards which it approves or are approved by its delegates.

The register includes:

  • the development application number and description
  • the property address
  • the standard to be varied
  • the extent of the variation.
