Joint Regional Planning Panel exercising functions for Kempsey Shire Council.

Description of the proposed development

Extractive Industry - Remove stockpile of waste ilmenite to natural ground level and rehabilitate site.

Designated development

The proposed development is designated development.

Integrated development

The proposed development is integrated development. The approvals that are required and the relevant approval body for those approvals is:

  • Mining Act 1992 - The Mining Act 1992 (Mining Act) is administered by the Division of Mining, Exploration and Geoscience (MEG) within the DPIE

Threatened species development

The proposed development is threatened species development.

The application and documents may be inspected by the public

The development application and the documents accompanying the application, including the environmental impact statement, may be inspected at Kempsey Shire Council’s website www.kempsey.nsw.gov.au/council/public-exhibition

Advertising period

The exhibition period for the proposed development commences on 1 April 2021 and ends on 4 May 2021.

Submissions

Any person during the period specified in the notice may make a written submission in relation to the development application to Kempsey Shire Council. Submissions must quote the reference number T6-20-207 and may be posted to Operations & Planning, Kempsey Shire Council, PO Box 3078, West Kempsey, NSW, 2440 or emailed ksc@kempsey.nsw.gov.au

If the submission is an objection to the proposal, the grounds/reasons for the objection must be stated.

A person or associate of the person who makes a submission in relation to the application must make a disclosure of any reportable political donation of gift made in the previous two years (and up to the time the matter is determined). The disclosure (Disclosure Statement of Political Donations or Gifts) will need to accompany the submission. A Disclosure Form and further details can be obtained from Council’s website or Customer Services.

Copies of the submissions may be publicly available, unless it is specifically requested by the writer not to be included and the submission is headed “confidential”.

Unless the proposed development is development about which the Planning Assessment Commission has conducted a review, any person who:

  • makes a submission by way objection, and
  • who is dissatisfied with the determination of the consent authority to grant development consent,

may appeal to the Land and Environment Court.

If the Planning Assessment Commission conducts a review, the Minister’s determination of the application is final and not subject to appeal.
